Terms and Conditions of provision of services by electronic means by Unitop sp. z o.o. with its registered office in Łódź

Article 1. Definitions

As used in these Terms and Conditions the following words and expressions shall have the following meaning:

Electronic Address – ICT system designation allowing for contact by means of electronic communication, in particular by electronic mail (e-mail address);

Websitewww.sesamesnaps.ca;

ICT System – set of cooperating IT devices and software used for processing and storing as well as sending and receiving data by telecommunications networks with the use of a telecommunications end device, relevant for a given type of network, within the meaning of the Telecommunications Law Act of 16 July 2004;

Provision of Services by Electronic Means – provision of the Service by way of sending and receiving data with the use of ICT Systems, upon individual request of the User, without simultaneous presence of the parties being required, such data being transmitted with the use of public networks within the meaning of the Telecommunications Law Act of 16 July 2004;

Service Provider – Unitop sp. z o.o. with its registered office in Łódź (ul. Andrzeja Struga 61, 90-959 Łódź), entered in the Register of Entrepreneurs of the National Court Register maintained by the District Court for Łódź-Śródmieście in Łódź, KRS No. 0000616626, REGON No. 364407260, NIP No. 5252658641;

Services – services provided by the Service Provider via the Website with the use of the ICT System, described in Article 3(1) of these Terms and Conditions;

Act – the Act on Provision of Services by Electronic Means of 18 July 2002;

User – natural person, legal person or unincorporated organisational unit who/which uses the Services provided by the Service Provider via the Website.

Article 2. General provisions

1) These Terms and Conditions set forth:

a) the rules of use of services provided by electronic means, available on the Website, including in particular the rights and duties of the Service Provider and the Users,
the scope and types of services provided by electronic means on the Website.

b) the Users shall read these Terms and Conditions before they start using the Services and shall comply with the provisions of these Terms and Conditions.

2) The Service Provider shall provide the Services by electronic means in accordance with the Terms and Conditions and the Act.

3) The Terms and Conditions shall be made available to the Service Recipient free of charge on website www.sesamesnaps.ca.

Article 3. Scope of services provided by electronic means

1) The Service Provider shall provide the following Services via the Website:

a) featuring certain products of the Service Provider and other information relating to the Service Provider, including contact details, on website www.sesamesnaps.ca, as a result of which the User may acquaint himself or herself with the featured products of the Service Provider and contact the Service Provider in order to obtain information about the offer, availability and scope of the products and about the services provided by the Service Provider as part of its business activity.

b) contact form, hereinafter referred to as the “Contact Form”, which consists in making available to the Users, free of charge, a tool for contacting the Service Provider with a view to obtaining information about the offer, availability and scope of the products and about the services provided by the Service Provider as part of its business activity.

2) Content made available on the Website shall constitute the Service Provider’s sole property.

Article 4. Terms and conditions of provision of services by electronic means

1) In order to properly use the Services, the User shall have computer equipment with installed web browser and Internet connection.

In the case of the Contact Form, it is also necessary to have an active electronic mail account.

2) The Service Provider reserves the right to:

a) refuse to provide the Services if the User breaches these Terms and Conditions or the provisions of generally applicable law or takes steps which interfere with uninterrupted use of the Website or the Services by other Users,

b) refuse to provide the Services if the User provides incorrect or untrue data, required for giving a reply to a question asked via the Contact Form,

c) temporarily or permanently cease providing the Services on account of maintenance activities or activities connected with modification of the Website.

3) The Users who use the Services via the Website shall:

a) not send any content which is illegal, violates legally protected personal rights of third parties or copyright,

b) not use the Services in any manner which is contrary to the law, these Terms and Conditions, good morals or violates personal rights of the Service Provider.

Article 5. Entry into and termination of the agreement on provision of services by electronic means

1) Commencement of the use of the Services shall be tantamount to entering into an agreement on provision of services by electronic means with the Service Provider and acceptance of the Terms and Conditions. Prior to entering into the agreement for provision of services by electronic means, the User shall read the Terms and Conditions.

2) The agreement shall be entered into upon:

a) opening the Website www.sesamesnaps.ca – in the case of the Website;

b) sending a message via the Contact Form after correct completion of boxes in the Contact Form – in the case of the Contact Form.

3) The agreement on provision of services by electronic means shall be entered into for the duration of such services, i.e.:

a) in the case of the Website – until the website is closed;

b) in the case of the Contact Form – upon sending an answer to the User’s question asked via the Contact Form on the Website or upon leaving the Contact Form.

4) Entering into the agreement for provision of services by electronic means shall not entail payment of any fees by the User to the Service Provider.

5) The User may use the services anonymously, i.e. without providing any personal data, except for the Contact Form.

6) The use of any functionalities of the Contact Form shall require obligatory provision of the User’s name and e-mail address and reading these Terms and Conditions.

7) The User shall have the right to cancel the Contact Form service before obtaining an answer to his or her question. To do so, it is sufficient to leave the Website.

8) If the User sent a question via the Contact Form and changes his or her decision to expect an answer to that question, he or she may cancel the Contact Form service by sending a statement on cancellation of the Contact Form service to the Service Provider to electronic address marketing@unitop.com.pl from the electronic address (e-mail) provided in the Contact Form.

9) The Service Provider reserves the right to cease provision of the Services at any time.

Article 6. Liability of the Service Provider

1) The Service Provider shall not be liable for:

a) interruptions to access to the Services resulting from necessary technical and administrative actions,

b) interruptions to the functioning of the Internet network, provision of the Internet network and access to the Services resulting from a Force Majeure event,

c) cessation to provide the Services to the Users who committed a breach of these Terms and Conditions,

d) any damage caused to third parties as a result of the Users using the Services contrary to the Terms and Conditions and the provisions of generally applicable law,

e) refusal to provide the Services if the User provides incorrect or untrue data, required for giving a reply to a question asked via the Contact Form,

f) temporary or permanent cessation of provision of the Services on account of maintenance activities or activities connected with modification of the Website,

g) cessation of provision of the Services by the decision of the Service Provider.

2) For safety reasons, with a view to repairing any defects and eliminating any possible threats, the Service Provider reserves the right to temporarily suspend the Website in order to modify it, update data, change content of the Website. The Service Provider shall not be liable for any situations referred to hereinabove.

Article 7. Complaints

1) The Users shall have the right to submit complaints regarding matters relating to provision of the Services.

2) A complaint may be any reservation or comment relating to provision of the Services.

3) Complaints shall be sent to electronic mail address: cok@unitop.com.pl or in writing to the Service Provider’s address indicated in these Terms and Conditions.

4) The Service Provider shall examine a complaint within 21 days from the date of receipt and reply to the electronic mail address from which the complaint was sent, unless the complaining User indicated another, traditional or electronic, address for the reply.

5) A complaint should contain all information allowing for its examination. If examination of the complaint requires additional information, the Service Provider shall contact the complaining User with a view to supplementing it.

Article 8. Final provisions

1) The Service Provider shall have the right to unilaterally amend the Terms and Conditions for important reasons, including in particular a change of legal provisions affecting performance of these Terms and Conditions.

2) The Service Provider shall notify the User of any amendment to the Terms and Conditions by publishing appropriate information on the Website.

3) To any matters not regulated in these Terms and Conditions, relevant provisions of generally applicable law, in particular the provisions of the Act, shall apply.

4) Detailed rules on processing of personal data are set forth in the Privacy Policy published on the Website.
